Britney Agrees To Give Kevin Sole Custody

Britney Spears has agreed to hand the parenting reins over to Kevin Federline.

K-Fed's longtime attorney Mark Vincent Kaplan exclusively tells E! News that the divorced duo have reached a settlement in their long-gestating custody case.

According to the agreement signed by all parties, Federline gets sole legal and physical custody of sons Sean Preston and Jayden James and Spears will have visitation rights.

"The case has been settled," Kaplan said. "The court still has to approve it. " Both parties are due in court Friday morning.

The case had been set to go to trial next month but all had been hoping to settle up beforehand. "As of this evening there is a fully executed deal memo...All the issues that would have been addressed at trial have been settled," Kaplan told E! News. "Can't speak to the exact terms of the deal. Orders in place...will stay in place."

But although this is theoretically good news for Federline, Kaplan maintains that this isn't exactly what his client had in mind.

"Kevins was not [out] to get custody. Kevins goal was to set up some kind of template so the mother of his children can co-parent," Kaplan said. "He said I need to have Britney to be involved in the coparenting of the kids but I need there to be a structure."

But this is the structure he got and "Kevin is absolutely delighted," Kaplan continued.

"Nobody could have anticipated the terms of events that have occurred....This was a two-year journey that will be halted at a point that is good for these children. Custody is always modifiable. If there is a final order, it means there is nothing to try."

Spears has been enjoying monitored visits with her boys since late February after temporarily losing any on-hand-mommying privileges following a stretch of noticeably erratic behavior on her part and two brief hospital stays.

Federline's camp has credited the influence of Spears' father Jamie, who was appointed a coconservator of his daughter's estate Feb. 1, for helping to get the 26-year-old popster back on track.

A court commissioner is scheduled to review whether the make the conservatorship permanent at the end of this month. If the arrangement were to end, what then happens to Spears' current deal?

"While I can't tell you the terms, the order does anticipate what happens if the conservatorship is ended," Kaplan told E! News. "The devil is always in the details and this is a very detailed deal memo. Nobody can predict what the future will bring but ...to the extent possible I think we have really anticipated how to proceed."

In a shocking new development, OK! has learned exclusively that Britney Spears has ended her battle to win back custody of her children, Sean Preston and Jayden James, from ex-husband Kevin Federline.

In an exclusive interview with OK!, Kevin's attorney Mark Vincent Kaplan says both Britney and Kevin reached and signed off on a settlement in their custody case today.

Kaplan tells OK!, "At about 8 p.m. PT, a final settlement in the Kevin Federline-Britney Spears custody case was signed. All parties have agreed to the following: Kevin will retain sole legal and physical custody of Sean Preston and Jayden James. Britney will continue to have visitation rights which may increase over time. The agreement will be presented to the court in the morning for approval by the commissioner."

Kaplan adds, "Kevin is ecstatic and the boys are thriving."

Britney, who remains under the legal conservatorship of her father Jamie Spears, lost custody of her sons to Kevin last October. At the time she had visitation privileges but they were severely restricted following her January hospitalization for psychiatric evaluation. She currently has monitored visitation with her sons two days a week and one overnight.

Poor kids. The mother is a fat, thoughtless has-been, and the father is a degenerate gold digging loser. In 12 years or so, we'll read about the kids either dying, or strung out on heroin.

^ Except that he willing admits that the nanny does everything. So the statement should read the kids are better of in the nanny's hands.

There is no winner in this case unfortunately. Children need both parents and luckily regardless of legal mumbo jumbo both parents seem to understand that. Their mother is getting them for 4 or 5 days a week with an increased number of overnights even while she doesn't have custody.

To Anonymous- has been? She did a complete turn around. You don't know what kind of Mom she is or what she went through. Only what you read. I don't think Kevin should be getting so much child support. He should be given enough to take care of the kids. He doesn't need an expensive car, house etc.... He should get a job and support himself. However, I think Brittney is on the right road and I hope she continues to do so and regains custody of the boys and stops supporting Kevin.

and the title is wrong britney is not agreed but her lòawyers are more smart than kevin's one... she is getting 3 days and 2 overnights visits, and she is under conservatoship when she will be health again i wonder what she will get if she is getting now almost 50% under conservatorship, in two years she can have like 70% of the custody! this blog sucks cause it didn't explain this good,kevin is a loserrrrrrrrrrrrrr

To the person that said Britney is a fat has been, she is not fat and her album blackout sold 2.2 million cds so far without any appearances from her on any shows. So has been I think not. She couldn't be too much of a has been your writing about her and no one even knows your name.
