TMZ has confirmed Britney Spears is back in rehab.
We're told the singer is hoping three times is a charm. The emergency custody hearing that Kevin Federline wanted has been cancelled because of the new development. There will be no custody hearing today.
Sources tell TMZ Federline is concerned for Spears' welfare and wants her to get the help she is now seeking. We're also told this will be Spears' last chance -- if she leaves rehab before getting full treatment, Federline will immediately go to court seeking orders allowing him unquestioned full custody of the children.
We're told Spears showed up at Federline's house last night and he wouldn't let her in.
Sources say the kids are now in the custody of Federline, and have been since last week.
TMZ has just confirmed Spears' inpatient rehab program is supposed to last between 30 and 45 days.

Mark Vincent Kaplan, a lawyer for Spears's estranged husband, Kevin Federline, confirmed through a spokesman that the pop star has entered a treatment facility – and that a custody hearing over the couple's two sons has been canceled
According to the spokesman, no emergency papers will be filed as had been planned in the custody matter.
According to Michael Sands, a rep for Federline's lawyer: "There was never a hearing officially scheduled and there's not going to be a hearing today from what I understand. Kevin remains a very focused father."
Allan Parachini, the public information director for L.A. Superior Court, explained to Usmagazine.com that while "an inquiry" was made to the court clerk yesterday, he cannot confirm who made it. "The person who made the inquiry was told they would be accommodated," Parachini says. "However, nothing was ever officially filed."
A Federline source says just because Spears has entered rehab again that doesn't mean Federline's attorney, Mark Vincent Kaplan, still won't aggressively litigate a custody battle, explaining that "Mark Vincent Kaplan is no shrinking violet."
Meanwhile, Usmagazine.com has learned that Spears turned up at Federline's house yesterday evening, rang the buzzer three times but was not let inside. Then she stormed off, only to resurface later that night at Promises with a bodyguard in tow.
