Britney back in rehab, hearing cancelled, Kevin has temporary custody

TMZ has confirmed Britney Spears is back in rehab.

We're told the singer is hoping three times is a charm. The emergency custody hearing that Kevin Federline wanted has been cancelled because of the new development. There will be no custody hearing today.

Sources tell TMZ Federline is concerned for Spears' welfare and wants her to get the help she is now seeking. We're also told this will be Spears' last chance -- if she leaves rehab before getting full treatment, Federline will immediately go to court seeking orders allowing him unquestioned full custody of the children.

We're told Spears showed up at Federline's house last night and he wouldn't let her in.

Sources say the kids are now in the custody of Federline, and have been since last week.

TMZ has just confirmed Spears' inpatient rehab program is supposed to last between 30 and 45 days.

If Britney leaves rehab before getting full treatment, which is expected to last a minimum of 30 days, Kevin will immediately go to court seeking orders allowing him unquestioned full custody of the children.

A crazed Spears arrived at Federline's house last night but he wouldn't let her in.

Both Tater Tot and Small Fry have been staying with Kevin since last week.

Despite their strained relationship these last few months, Extra TV is reporting that Lynne Spears, Britney's mother, was with the addict last night and was the one that drove her back to the Promises rehab center, which she has checked into again in order to keep her babies.

Mark Vincent Kaplan, a lawyer for Spears's estranged husband, Kevin Federline, confirmed through a spokesman that the pop star has entered a treatment facility – and that a custody hearing over the couple's two sons has been canceled

According to the spokesman, no emergency papers will be filed as had been planned in the custody matter.

According to Michael Sands, a rep for Federline's lawyer: "There was never a hearing officially scheduled and there's not going to be a hearing today from what I understand. Kevin remains a very focused father."

Allan Parachini, the public information director for L.A. Superior Court, explained to Usmagazine.com that while "an inquiry" was made to the court clerk yesterday, he cannot confirm who made it. "The person who made the inquiry was told they would be accommodated," Parachini says. "However, nothing was ever officially filed."

A Federline source says just because Spears has entered rehab again that doesn't mean Federline's attorney, Mark Vincent Kaplan, still won't aggressively litigate a custody battle, explaining that "Mark Vincent Kaplan is no shrinking violet."

Meanwhile, Usmagazine.com has learned that Spears turned up at Federline's house yesterday evening, rang the buzzer three times but was not let inside. Then she stormed off, only to resurface later that night at Promises with a bodyguard in tow.

Looks like they managed to get her back in rehab, hope she stays this time. I'm glad Kevin's taking care of the kids.

Lol. Yet his idiotic fans did all of that teasing, and bragging for nothing. I wonder what caused Kevin to cancel the emergency arrangement. Hmmmm. Anyways...I'm glad the kids are being taken care of, while Brit is getting the help she needs, and deserves.

Uh! He doesn't have temporary custudy as nothing was filed within the courts granting him such. He likely has them with him now, but that is not the same thing as having custody! The agreed upon decree legally still stands until it is otherwise modified within the courts.

The only thing that matters now is that Kevin is caring for the kids, Britney is back in rehab trying to get the help she need(hopefully), this is all heading in the right direction, and if everyone do their part then the future will start to look brighter, for everyone involved.

Kaplan has released a statement to Fox News saying they never had plans for a court case! It is also said that Kevin and Britney have reach the agreement that while she is in rehab, he gets the children.

So I guess here blows the nasty battle theories out of the water!

I'm glad they can settle the custody battle amicably at this point. Let's hope Britney recovers enough of her sanity not be a bad influence when the children grow older.
